1General Policy

Because Prior Notice filings are time-sensitive regulatory submissions to the U.S. Food and Drug Administration (U.S. FDA), all services are provided on a non-refundable basis once work has commenced or a filing has been submitted.

We strive to provide clear communication throughout the process to ensure you understand the status of your filing at all times.

2Cancellations Before Filing

If you cancel before we begin preparing or submitting your Prior Notice, a full refund will be issued, minus any credit-card transaction fees (typically 2.9% + $0.30 per Stripe policy).

To request a cancellation, please contact us immediately before any work has begun on your filing.

3Discrepancies in the Number of Unique Products

Service fees are calculated based on the number of unique food products declared by the customer during order submission.

If, upon document review or data verification, a discrepancy is found between the number of unique products declared and the actual number determined from the provided documentation, the customer will be notified immediately and given two options:

  • Pay the additional amount corresponding to the revised number of unique products; or
  • Receive a full refund of the original payment if they choose not to proceed

No Prior Notice filing will be submitted until the discrepancy is resolved through one of these options.

4Errors or Duplicate Payments

If an error occurs due to duplicate payment, billing mistake, or incorrect charge, please contact us within 7 business days of the transaction.

Verified overpayments will be refunded promptly to the original payment method.

Please include your transaction ID and order details when contacting us about payment errors.

5Regulatory Rejection

If an FDA Prior Notice is rejected due to inaccurate or incomplete information provided by the Registrant, no refund will be issued.

However, we will assist in resubmitting a corrected filing at a discounted rate where feasible.

We are committed to working with you to ensure successful submission of your Prior Notice filing.

6Service Guarantee

If Prior Notice Services LLC fails to submit your Prior Notice as agreed and within the promised timeframe, we will either:

  • Issue a full refund, or
  • Apply a service credit toward a future filing—at your choice
